Is the acknowledgment of a third heir by a legally competent heir valid if some other heirs are legally incompetent (minor or insane)?
General Chapter
Al-Mughni
Book of Acknowledgment of Rights
Primary text
If one heir is legally incompetent (a minor or insane person) and the competent heir acknowledges a third sibling, the lineage is not established solely based on the competent heir's acknowledgment because he does not represent the entirety of the inheritance rights. However, if the minor reaches maturity or the insane person recovers sanity, and they also acknowledge the third party, the lineage is established due to the unanimous acknowledgment of all heirs. If they deny it upon recovery, the lineage is not established.
Supporting text
If both the minor and the insane person die before becoming legally competent, the lineage of the acknowledged person is established because the acknowledgment originated from all those who would have inherited, meaning the acknowledged person becomes entitled to the entirety of the estate.
