Is an admission of obligation accepted regarding rights that are conditional upon action, such as returning a greeting or blessing a sneezer?
General Chapter
Al-Mughni
Book of Acknowledgment of Rights
Primary text
If the specification is the returning of a greeting (*radd as-salām*) or blessing a sneezer (*tashmīt al-‘āṭis*), it is not accepted because these rights lapse upon their missed opportunity and thus cannot be established as a fixed liability in the *dhimma*. This type of admission indicates the establishment of a right in the liability.
Supporting text
There is an interpretation suggesting acceptance if the declarant intends that a right upon them is to return the greeting when greeted or to bless the sneezer, based on the hadith stating that a Muslim has thirty rights over another Muslim, including returning the greeting and blessing the sneeze.
