Is an admission stating, "Half of this house belongs to so-and-so," or "Part of this property of mine belongs to him," valid?
General Chapter
Al-Mughni
Book of Acknowledgment of Rights
Primary text
The validity of such an admission is supported by the narration that the admission concerning 'the horse I own belongs to so-and-so' is permissible. Therefore, the apparent meaning indicates the validity of the admission. Stating, 'He has half of this property,' or 'He has half of this house,' constitutes a valid admission.
Supporting text
There are two narrations transmitted from Ahmad regarding the statement, 'Half of this slave of mine belongs to so-and-so.' One narration suggests it is not valid unless he says, 'I have gifted it' (wahabtuhu). Another report from Ibn Mansur indicates that stating 'My horse belongs to so-and-so' confirms the validity of the admission.
