Is a prior admission of parentage revocable by the declarant?
General Chapter
Al-Mughni
Book of Acknowledgment of Rights
Primary text
When parentage is established through a declaration (Iqrar), subsequent denial by the declarant is not accepted. This is because the lineage has been established through a legitimate religious proof (hujjah shar'iyyah) and cannot be nullified by mere denial, similar to lineage established by testimony (bayyinah) or established parentage (firash). This ruling applies whether the person whose parentage was admitted was accountable (mukallaf) or not, provided the declarant maintained their initial admission.
Supporting text
There is a possibility that if the person whose parentage was admitted is accountable (mukallaf), the lineage can be negated if both parties agree to retract the admission, as it was established by their mutual agreement and can thus be dissolved by their mutual retraction, analogous to a financial matter (mal).
