If the declarant refuses to specify the debt acknowledged, they are imprisoned because they are withholding a right against them, similar to the case where the debt is specified but payment is refused. This obligation continues even if the original declarant dies; their heirs must settle the debt from the deceased's estate because the right was established against the deceased. If the deceased left no estate, the heirs bear no liability.

The opinion of Al-Qadi states that if the creditor specifies the item and the declarant refuses, the declarant is deemed recalcitrant, and the creditor may be made to swear an oath regarding their claim, which is then imposed upon the declarant.
