Primary text

The person making this statement is required to provide an explanation (bayan). If the explanation given is, 'He paid a thousand for its price on my behalf,' this constitutes an acknowledgement of a loan (qardh). If the explanation is, 'He paid a thousand into its price,' the inquirer must press for details regarding the slave's total price and the manner of its purchase. If the claimant asserts a single offer and acceptance ('ijab wahid') where both amounts—the claimed amount and the paid amount—were one thousand, the respondent is acknowledging ownership of half the slave. If the respondent claims, 'I weighed out two thousand,' the respondent is acknowledging ownership of one-third of the slave. In this latter situation, the respondent's statement, coupled with an oath, is accepted, regardless of whether the actual value matches the amount mentioned, as there might have been overpayment or underpayment.
