Is agency (Wakala) established with the testimony of one man and two women when claiming agency?
General Chapter
Al-Mughni
Book of Agency
Primary text
If a person claims agency and presents one male witness and two female witnesses, agency is established when the agency pertains to financial matters, according to one narration attributed to Ahmad. This is because the purpose intended by the agency is money, allowing the testimony of women alongside men, similar to the ruling for sales contracts and loans.
Supporting text
A second narration states that agency is not established except through the testimony of two upright male witnesses. This is the position held by Al-Kharqi and Al-Shafi'i, based on the premise that agency establishes an act of disposition (Tasarrruf).
