Can the agent purchase an item if they know of its defect prior to the purchase?
General Chapter
Al-Mughni
Book of Agency
Primary text
The permissibility of the agent purchasing the item when aware of the defect prior to the transaction depends on the ruling regarding the agent's right to reject the item after the transaction is complete. If the ruling is that rejection is permitted after purchase, then purchase without disclosure is prohibited, as preventing the purchase when the defect is known beforehand is the stronger position.
Supporting text
If the ruling is that rejection is not permitted after the purchase, then the agent is permitted to purchase the item when aware of the defect beforehand, because the principal's specification overrides the need for the agent's independent judgment regarding rejection or purchase.
