Anyone whose personal transactions are valid, and which admit delegation, may appoint an agent. This includes a man, a woman, a free person, a slave, a Muslim, or a non-Muslim.

Supporting text

Those who act by permission, such as a permitted slave (al-ma'dhun lahu), an agent, or a managing partner (Mudharib), are excluded from the general rule regarding delegation of their primary functions.
