When is the fee earned for agency concerning sale, purchase, or Hajj?
General Chapter
Al-Mughni
Book of Agency
Primary text
If the agency is for selling, buying, or performing Hajj, the agent earns the fee upon completing the act, even if the purchase price (Thaman) in a sale is not yet collected by the agent.
Supporting text
If the principal sets a condition stating, 'If you sell the garment, collect its price, and deliver it to me, then you will have the fee,' the agent earns nothing until the delivery is made. If the delivery fails, the agent receives nothing because the condition precedent has lapsed.
