Does the immorality (fisq) of the agent terminate their agency?

The immorality of the agent does not cause their termination from the agency because they remain qualified for legal disposition. However, if the agency pertains to an act that immorality contradicts, such as proposing marriage (ijab fi 'aqd al-nikah), the agent is terminated due to their immorality or the immorality of the principal, as the latter results in the principal losing legal capacity.

If the agent is authorized only for acceptance in marriage on behalf of the principal, the agent is not terminated by the principal's immorality, as the principal's immorality does not invalidate the agent's capacity to accept. Regarding termination due to the agent's own immorality in this specific case of acceptance, there are two differing scholarly opinions.
