Is a mandate valid to sell 'whatever you wish' from the principal's property?
General Chapter
Al-Mughni
Book of Agency
Primary text
If one authorizes the sale of 'whatever you wish from my property,' it is permissible because if authorizing the agency concerning the entirety of the property is valid, then authorizing it concerning a part is more fitting.
Supporting text
The companions of Al-Shafi'i stated that authorizing the sale of 'whatever you wish from my property' is not permissible, although authorizing the sale of 'from my slaves' is permissible because it is restricted by category (jins).
