What obligation does an agent have if the appointed delegate becomes untrustworthy?
General Chapter
Al-Mughni
Book of Agency
Primary text
If an agent delegates their authority to a trustworthy person who subsequently becomes treacherous or dishonest (Kha'in), the original agent is obligated to dismiss (remove) that delegate. This obligation stems from the fact that allowing the dishonest person to continue acting constitutes waste and dereliction of duty on the part of the original agent. The very nature of agency requires the appointment of a trustworthy individual, and a dishonest person does not meet this requirement; therefore, their removal becomes mandatory.
