If one of the witnesses who testified to the agency later recants, stating the agent was dismissed, the judge must not rule based on their testimony. This is because the recantation constitutes a withdrawal from the testimony prior to a ruling being issued, and a judge cannot rule based on testimony from which the witness has withdrawn.
