Is a slave authorized to emancipate his own slaves valid?
General Chapter
Al-Mughni
Book of Agency
Primary text
If a slave is authorized to emancipate his own slaves, or a woman is authorized to divorce her own female slaves, the slave does not gain the right to emancipate himself, nor does the woman gain the right to divorce herself. This is because the authorization, by its explicit nature, refers to disposition over others.
Supporting text
An alternative view suggests that the slave and the woman do possess this right, drawing from the general wording of the authorization, similar to how a sales agent may sell to himself based on one narration.
