What is the status of ownership for an apostate who subsequently returns to Islam, concerning property acquired during apostasy?
General Chapter
Al-Mughni
Book of the Apostate
Primary text
It is subject to debate whether anything established during apostasy will take effect upon his return to Islam, because the cause (*sabab*) did not establish its ruling then. Another view holds that ownership becomes established for him at that time because the cause exists; the prevention of its ruling was due to the lack of fitness, and once fitness is present, the condition is met, and ownership is established, similar to how his properties that were voided during his unfitness revert to him.

Based on the second view, if he dies or is killed, the ownership transfers to his inheritors, as this situation is analogous to the establishment of property.
