What is the consequence of paying a debt early when it was guaranteed with a deferred term?
Chapter on Guarantee (Daman)
Al-Mughni
Book of Assignment (Transfer of Debt)
Primary text
If a debt guaranteed to be due in one month is guaranteed until two months, the creditor cannot claim payment from the guarantor until two months have passed. If the guarantor pays before the deferred term, he has the right to recourse immediately, according to the narration which states that if one pays a debt without permission, they may seek recourse. This is because, in this scenario, the most that can be argued is that payment occurred without permission.
Supporting text
According to another narration, recourse is not permitted before the due date because the creditor did not permit payment prior to that date.
