The guarantee contract (Kafalah) is valid whether it is immediate (hal) or deferred (mu'ajjalah), similar to suretyship (Dhaman). If the term is unspecified, it is considered immediate because any contract that permits immediacy upon stipulation implies immediacy by default, such as the price or suretyship. If the guarantee is immediate, the guarantor has the right to demand the presence of the guaranteed person.
