A guarantee or surety is invalid if the guarantor stipulates, 'I guarantee this debtor to you, on the condition that you absolve me from the guarantee concerning so-and-so,' or 'I assume liability for this debt, on the condition that you absolve me from the liability of the other debt.' This is invalid because it constitutes stipulating the annulment of one contract within the terms of another contract, which is impermissible, similar to a sale conditioned upon the annulment of another sale.
