Is guaranteeing compensation for bodily harm (*Arsh al-Jinaayah*) valid?
Chapter on Guarantee (Daman)
Al-Mughni
Book of Assignment (Transfer of Debt)
Primary text
The guarantee of compensation for bodily harm is valid, whether the required payment is in currency (like the value of destroyed property) or livestock (like blood money/diyah). Evidence confirms the validity of guaranteeing unknown amounts when obligation is concerned, and specifically for camels due as compensation, the number and age are known, while uncertainty about color or other remaining characteristics does not invalidate it, as the minimum standard will be met upon fulfillment.
Supporting text
The school of Al-Shafi'i maintains that guaranteeing the required livestock in such cases is invalid because the livestock itself is considered unknown (indeterminate).
