What is the right of return when permission is partial among multiple guarantors and the guaranteed party?
Chapter on Guarantee (Daman)
Al-Mughni
Book of Assignment (Transfer of Debt)
Primary text
If the first guarantor permits the second guarantor to guarantee, but the guaranteed party does not permit the second guarantor, the one who was permitted (the second guarantor) returns against the one who permitted him (the first guarantor). Similarly, if the guaranteed party permits his guarantor, but that guarantor does not permit the subsequent guarantor, the permitted one returns against the one who permitted him. In one narration, the other party has no right of return.
