What is the ruling on the guarantee provided by a sick person?
Chapter on Guarantee (Daman)
Al-Mughni
Book of Assignment (Transfer of Debt)
Primary text
If the illness is not life-threatening or an illness leading to death (Marad al-Mawt), the ruling on their guarantee is the same as that of a healthy person. If it is a life-threatening illness, the ruling on their guarantee is that of a gratuitous gift, and it is calculated from one-third of their estate, because it is an undertaking of liability without receiving compensation in return.
