Is a bequest to sell a slave conditional upon freeing the slave valid?
General Chapter
Al-Mughni
Book of Bequests
Primary text
The bequest is valid, and the sale contingent upon manumission is also valid. This is because the sale, in this context, benefits the slave through the act of emancipation.
Supporting text
If a buyer meeting this condition cannot be found, the bequest becomes void due to impossibility, similar to when a bequest is made to purchase a slave for manumission, but the master refuses to sell.
