Is a bequest of the yield of a tree for a duration, or for perpetual yield, valid?

Primary text
If a person bequeaths the fruit of a tree for a specified period or for whatever it perpetually yields, neither the legatee nor the heir can compel the other to water the tree. This is because one is not obliged to water their own property, nor are they obliged to water the property of another. However, if one desires to water it in a manner that does not harm the other party, the other party cannot prevent it. If the tree dries up, its firewood belongs to the heir.
