Primary text
If a testator leaves behind four sons and bequeaths to a man one-third of his wealth minus the share of one son, or bequeaths to him the completion of one-third based on one son's share, the recipient is entitled to one-ninth (al-tisu'). The calculation is as follows: After deducting one-third of the wealth for the bequest, two-thirds remain for the three remaining sons, resulting in two-ninths for each son. Thus, the son's share within that third is two-ninths, leaving one-ninth for the legatee.
