The effect of the condition in a bequest when the specified person arrives before the testator's death
General Chapter

Book of Bequests
Primary text
If the absent person arrives before the death of the testator, that person becomes the legatee, and the original bequest is nullified, regardless of whether the person subsequently returns to absence or not. This is because the condition for the transfer of the bequest has been met, and it does not transfer away from him after that point.
