What is the ruling if the sick person says, 'If I free Sa'd, then Sa'eed is free, or Sa'eed and 'Amr are free at the moment I free Sa'd'?
General Chapter
Al-Mughni
Book of Bequests
Primary text
The ruling is the same as stated previously; there is no difference. This is because the manumission of Sa'd is a condition for the manumission of both Sa'eed and 'Amr. If a portion of the one-third is depleted such that their condition for freedom is invalidated, the precedence of freeing Sa'd is established.
Supporting text
If the condition (manumission of Sa'd) occurs during health, and the manumission (of the others) occurs during illness, the ruling remains as previously described.
