If two executors were appointed with authority to act individually, what happens if one dies or is removed?
General Chapter
Al-Mughni
Book of Bequests
Primary text
If each of the two executors was granted the authority to act independently, and one dies or is removed from the executorship, the judge is not to appoint a trustee in his place. This is because the remaining executor possesses the authority to act based on the bequest and requires no other assistance.
Supporting text
If both co-executors die or are removed, the judge may appoint one successor to manage the affairs.
