Is the claim of self-defense against an intruder sufficient to avert retribution (Qawad)?
General Chapter
Al-Mughni
Book of Beverages (Intoxicants)
Primary text
If a man kills another claiming the deceased attacked his home and the killing was necessary for defense, the claim is not accepted without supporting evidence (Bayyinah). Retribution (Qawad) is mandatory upon the killer, regardless of whether the victim was known for theft or robbery or not. If evidence testifies that the deceased approached the killer with a recognizable weapon, then the blood money (Qawad) is nullified.
Supporting text
If the evidence testifies only to the deceased entering the killer's house without mention of a weapon, or mentioning a non-recognized weapon, retribution is not waived because the entry alone might be for some necessity, and mere proven entry does not justify nullifying the blood.
