Is it permissible to use a utensil where the silver mend is in direct contact with the mouth?
General Chapter
Al-Mughni
Book of Beverages (Intoxicants)
Primary text
It is disliked for one to drink directly from the location of the silver mend. Ahmad disliked this because it makes the user equivalent to one drinking from a silver utensil through direct contact during use. Similarly, a silver ring on a cup is disliked because the cup is lifted by the ring, causing direct contact during use.
Supporting text
Al-Qadi stated that necessity is not a prerequisite for the silver mend itself; minor mends are permissible even without direct need, provided the utensil is not used in a manner that involves direct contact. Ahmad's dislike centers specifically on the physical contact during use (mubasharah).
