The owner of a biting dog (*kalb 'aqoor*) is liable for damages it causes by biting a person or livestock, or by tearing a person's garment, whether this occurs day or night. Liability is established because the owner was negligent (*mufarrt*) in possessing such a dog. No liability rests upon the owner if the victim entered the owner's house without permission, because the victim was an aggressor (*muta'addi*) whose transgression caused the dog to attack him. If the victim entered with the owner's permission, the owner is liable because the victim's presence was consented to, thus causing the damage.
