What is the assessment for partial loss of speech based on articulation points?
Chapter on Diyat (Blood Money) for Wounds
Al-Mughni
Book of Blood-Money (Diyyāt)
Primary text
An alternative view holds that the *Diyah* should be divided according to the letters articulated by the tongue, excluding those articulated by the lip (Baa, Mim, Fa, Waw) and the letters of the throat (Hamza, Haa, Haa, Kha, Ain, Ghain). These excluded letters total ten. The remaining eighteen letters articulated by the tongue are where the compensation for the loss of speech rests, as the full *Diyah* is due for the cutting of the tongue, and the loss of these specific letters alone warrants compensation if the tongue remains. Under this calculation, the loss of one letter requires half of one-ninth of the *Diyah*, and the loss of two letters requires one-ninth of the *Diyah*.

The ruling that the *Diyah* is divided based on articulation points is an opinion held by some companions of Imam Al-Shafi'i. Furthermore, if injury to the lip or the throat causes the loss of some letters, compensation is due proportionally based on the twenty-eight letters universally.
