Is atonement (Kaffarah) obligatory upon killing a slave?
Chapter on Qasamah (Oaths regarding murder)
Al-Mughni
Book of Blood-Money (Diyyāt)
Primary text
Atonement is obligatory upon the killing of a slave. This is the position held by Abu Hanifa and Al-Shafi'i. The evidence supporting this ruling is the general statement of Allah Almighty: "And whoever kills a believer unintentionally, then [the penalty is] the freeing of a believing slave." (Quran 4:92). Furthermore, because retribution (Qisas) is obligatory for killing a slave, atonement must also be obligatory, just as it is for killing a free person. Additionally, the slave is a believer, thus resembling a free person, which differentiates the ruling from that applied to livestock.
Supporting text
Imam Malik stated that atonement is not obligatory because the slave's value is guaranteed (they are compensated for), which makes the matter similar to the ruling for killing livestock.
