Primary text

The established method, without dispute within the Madhhab as stated by Al-Kharqi, is that the blood money for accidental killing must be paid in five portions (Akhmas). This includes twenty Bint Makhad (year-old female), twenty Ibn Makhad (year-old male), twenty Bint Labun (two-year-old female), twenty Huqqah (three-year-old female), and twenty Jadha'ah (four-year-old female). This view is supported by Ibn Mas'ud, Al-Nukha'i, the companions of the opinion of Abu Hanifa, and Ibn al-Mundhir.

A dissenting view, held by Umar ibn Abd al-Aziz, Sulayman ibn Yasar, Al-Zuhri, Al-Layth, Rabi'ah, Malik, and Al-Shafi'i, maintains that the payment is in five portions, but they substitute Bint Labun for Ibn Makhad. A third position, attributed to Al-Hasan, Al-Sha'bi, Al-Harith al-'Akli, and Ishaq, states that it must be paid in four portions (Arba'), similar to intentional homicide (Diyyat al-'Amd). Taws states the composition is thirty Huqqah, thirty Bint Labun, thirty Bint Makhad, and twenty male Ibn Labun, based on a Hadith narrated by Abu Dawud and Ibn Majah.
