Is the color of the slave or female slave offered as Ghurra a determining factor in its acceptance?
General Chapter
Al-Mughni
Book of Blood-Money (Diyyāt)
Primary text
The color of the Ghurra is not considered a factor in its validity. The ruling is based on the Prophet's (PBUH) judgment of a slave or female slave in the abstract, despite the prevalence of dark skin among the slaves of his time. Similar to livestock due as a penalty (diyah), the color is not stipulated for an animal required by law to be rendered as compensation.
Supporting text
It is reported from Abu 'Amr ibn Al-'Ala' that the Ghurra must only be white, and a black male slave or a black female slave is therefore unacceptable.
