Primary text

Compensation is determined proportionally based on the amount of the Diyah for the whole ear, whether the cut is from the top, bottom, or middle, regardless of differences in beauty or function. This calculation applies universally, similar to teeth and fingers whose Diyats are fixed despite variations in beauty and utility. The established rule is that for any paired organ where full Diyah is due for both, half Diyah is due for one. Consequently, half the Diyah is due for half the ear, and a quarter Diyah for a quarter of the ear.

Supporting text

It is reported from Ahmad that the earlobe carries one-third of the Diyah; however, the primary established doctrine (Al-Madhab al-Awwal) adheres to the proportional calculation. The Diyah is due for the ear of a deaf person because deafness is a defect separate from the ear structure itself, and thus does not affect its Diyah, analogous to blindness not affecting the Diyah for the eyelids. There is no known opposition to this ruling.
