What is the compensation for the eyelashes (Ahdab) of the eyes?

Chapter on Diyat (Blood Money) for Wounds

Primary text

Full Diyah is incumbent for the eyelashes alone, which are the hairs upon the eyelids, with a quarter Diyah due for each individual lash. This is the opinion of Abu Hanifa. The rationale is that eyelashes possess beauty and utility, guarding and improving the appearance of the eyes, thus necessitating Diyah like the eyelids.

Supporting text

Al-Shafi'i holds that it requires a Hukuma (arbitrated compensation). If the eyelids are severed along with their lashes, no more than one Diyah is due because the hair is lost as a consequence of the lid's loss and is not compensated for separately, similar to fingers severed while still attached to a cut hand. Ata, Mujahid, Al-Hasan, Qatada, Al-Thawri, Al-Awza'i, Al-Shafi'i, the Ashab al-Ra'y, and Malik (in one narration) agree that a Hukuma is due in the two ears because the Sharia did not specify their measure, and measurement cannot be established through analogy. The supporting evidence for Diyah in ears includes the Prophet's letter to 'Amr ibn Hazm stating 'And for the two ears is the Diyah,' and the rulings of Umar and Ali establishing Diyah for ears.
