What is the compensation if a third party or the injured party removes the barrier between two established Muwaddihah wounds?
Chapter on Diyat (Blood Money) for Wounds
Al-Mughni
Book of Blood-Money (Diyyāt)
Primary text
If a stranger removes the barrier, the original assailant owes the Arsh for two Muwaddihah wounds, and the stranger owes the Arsh for one Muwaddihah. This is because the actions of the assailant and the third party are independent, with each being liable for their distinct injurious act.
Supporting text
If the injured party removes the barrier, the original assailant remains liable for the Arsh of two Muwaddihah wounds, as the liability established by his initial injury is not extinguished by the action of another party. If there is a dispute over who removed the barrier, the statement of the injured party is accepted because the grounds for the liability of two Muwaddihah wounds have already been established, and the injured party is denying the reduction of that liability.
