What is the consequence of severing the hand above the wrist according to an alternative opinion?
Chapter on Diyat (Blood Money) for Wounds
Al-Mughni
Book of Blood-Money (Diyyāt)
Primary text
The opposing view maintains that the term 'hand' encompasses everything up to the shoulder (al-Mankab), supported by the Quranic verse regarding ablution, 'And your arms up to the elbows' (Quran 5:6), and the practice of the Companions who wiped up to the shoulders during Tayammum. If severed above the wrist, only the Diyah for the hand is due because the entire portion severed is still referred to as a hand in common usage. In the context of theft, the intended purpose (of cutting off the means of theft) is achieved, and severing a part of something is termed cutting it, such as cutting a piece of cloth. Furthermore, the Diyah for severing the hand at the wrist is the same as the Diyah for severing all the fingers individually, and the Diyah for severing the penis from its root is the same as severing only the glans.
