What is the definitive ruling concerning the composition of the Diyyat al-Khata' paid in camels?
General Chapter
Al-Mughni
Book of Blood-Money (Diyyāt)
Primary text
The decisive ruling affirms the division into twenty units for each of the five required age categories: Huqqah, Jadha'ah, Bint Makhad, Bint Labun, and Ibn Makhad. This is supported by the narration of Abdullah ibn Mas'ud, as recorded by Abu Dawud, Al-Nasai, and Ibn Majah. Furthermore, Ibn Makhad cannot be substituted by Ibn Labun in this obligation because one cannot combine the substitute and the original item in a required payment, nor can they be combined when the cause for both is singular. Additionally, if the ruling were to mandate a higher number than the minimum established, proof (Tawqif) is necessary, which is lacking for the claimants of a higher count.
Supporting text
The ruling concerning the payment made for the victim killed at Khaybar, which was stated to be one hundred camels from the Zakat camels, is not evidence regarding Diyyat al-Khata', because the aggression against the people of Khaybar was alleged to be intentional, making its due compensation the Diyyat al-'Amd, which pertains to Zakat age categories, not the dispute over Diyyat al-Khata'. The position of Abu Thur, stating all blood money is paid in five portions regardless of intent, is disregarded as it contradicts the established traditions cited.
