If the loss of sight is confirmed and the experts state that there is no hope of recovery, the full Diyah is obligatory. If the experts state that recovery is hoped for within a specified period, the Diyah payment is deferred until that period elapses. If sight returns, the Diyah obligation is waived for the assailant. If sight does not return after the period ends, the Diyah becomes permanently established. If the injured party dies before sight returns, whether during the specified period or after, the Diyah remains established.

If the assailant claims the sight returned before the victim's death, but the heir denies it, the heir's statement prevails because the default position supports the heir.
