Is Diyah liability established upon a person who was poor at the time of the killing but became wealthy by the time the lunar year elapsed?
General Chapter
Al-Mughni
Book of Blood-Money (Diyyāt)
Primary text
The ruling is that the Diyah is obligatory upon such a person because wealth was attained at the time of obligation, meaning the person met the condition of being among the capable group (Ahl). This principle is extended to a minor who reaches puberty or an insane person who regains sanity exactly at the time the lunar year lapses; the obligation is established upon them.
Supporting text
An alternative possibility suggests the Diyah is not obligatory because the individual was not among the eligible parties at the time of the cause (the killing). This is analogous to a non-believer who acquires wealth and then converts to Islam exactly at the time of the Zakah year lapse; Zakah is not incumbent upon them.
