How is the Diyya determined if the gum exposes only a portion of the tooth?

Chapter on Diyat (Blood Money) for Wounds

Al-Mughni

Book of Blood-Money (Diyyāt)

Book 48 · Issue 3 · Bab 2

Open in Qurani

Primary text

The Diyya is determined based on the portion of the tooth that is outwardly visible according to common practice, excluding any part that became exposed due to unusual circumstances.

Supporting text

If the parties disagree on the extent of the normally visible portion, it should be assessed by comparing it to adjacent teeth. If there are no comparable teeth and expert knowledge cannot determine the extent, the statement of the assailant is accepted because the default presumption is the clearance of their liability.
