What is due if a hand is severed at the wrist, and then the remaining upper portion is severed later?
Chapter on Diyat (Blood Money) for Wounds
Al-Mughni
Book of Blood-Money (Diyyāt)
Primary text
If a hand is severed at the wrist, and subsequently the part above the wrist is severed, a discretionary indemnity (Hukm) is due for the second severance. This is because the full Diyah of the hand was established by the first severance. This parallels the situation where fingers are cut, and then the palm is cut afterward, or the glans of the penis is cut, and then the remainder is cut, or if two different individuals inflict these injuries sequentially.
