Is indemnity due for severing the tongue of a person who reached the stage of moving for crying but did not move?

If a person reached the stage where movement for crying or otherwise is expected but did not move, and their tongue was severed, no indemnity is due, because the outward appearance suggests that if the organ were sound, it would have moved.
