What is the legal meaning of Al-Qasamah (القسامة)?
Chapter on Qasamah (Oaths regarding murder)
Al-Mughni
Book of Blood-Money (Diyyāt)
Primary text
Al-Qasamah refers to the repeated oaths taken in a claim of murder. The jurist Al-Qadi defines it as oaths that are multiplied for exaggeration. Linguistically, it can also refer to the people who take the oaths, being named after the verbal noun, similar to calling someone 'a man of truth' (Zoor, 'Adl, Rida). Regardless of the interpretation, it fundamentally originates from the concept of swearing an oath (Al-Qasm).
