What is the liability for cutting stitches and re-injuring the wound after complete healing?
Chapter on Diyat (Blood Money) for Wounds
Al-Mughni
Book of Blood-Money (Diyyāt)
Primary text
If the second injury occurs after the wound has completely healed, the perpetrator is liable for the partial indemnity (arsh) of a penetrating wound and the cost of the thread, because the complete healing restored the body to its original sound state, making the subsequent injury equivalent to a fresh wound.
Supporting text
If only a portion of the wound has healed and the perpetrator ruptures the healed part, he is liable for the partial indemnity (arsh) of a penetrating wound, based on the principle above.
