The liability for an injury inflicted upon a minor or an insane person is the same as that for a sane adult. The distinction lies in representation: a sane adult is responsible for themselves, whereas the guardian is responsible for the minor or the insane person. If an oath is required regarding the injury, neither the minor nor the insane person takes the oath, nor does their guardian on their behalf. The oath becomes binding only when the minor reaches maturity or the insane person regains sanity.
