If the victim is half-free, no retaliation (Qisas) is exacted for his killing, as he is considered deficient due to his partial servitude, and a freeman cannot be killed in retaliation for someone who is not fully free, just as if he were entirely a slave. If the killer is a slave, the slave is executed in retaliation because the killer is considered more complete (in status) than the victim. If the killer is half-free, retaliation is due because they are equal in status.

If the killer's status of freedom exceeds that of the victim (i.e., the killer is more free than half-free), retaliation is not due due to the lack of equality. If the killer is a slave, and the killing was intentional, the killer owes half the freeman's Diyah and half the slave's value, as the *aqilah* does not bear responsibility for intentional homicide. If the killing was by error, the killer owes half the slave's value, as the *aqilah* does not bear responsibility for a slave's value; however, the *aqilah* owes half the Diyah because that portion relates to the Diyah of a freeman in cases of error, which the *aqilah* bears.
