Does a man who kills his slave, or kills someone and then apostatizes, have the right to take the Qasamah oath?
Chapter on Qasamah (Oaths regarding murder)
Al-Mughni
Book of Blood-Money (Diyyāt)
Primary text
There are two differing legal opinions regarding whether a man who kills his slave, or kills someone and subsequently apostatizes, may take the Qasamah oath. These two views are based on the preceding difference of opinion concerning the apostate heir.
Supporting text
If the killer returns to Islam, the right to Qasamah returns to him because he is entitled to the compensation (the value of the slave or blood money).
